Since we don't distribute/publish/sell the server files we don't have to publish the sources.

In general I don't have anything against publishing stuff because it keeps cod alive.

the problem is that nearly all servers have a decreasing population (except cj)
If we start an other server we may get the problem that all other servers will have less population then before because they'll spread over all servers
